WARRICK COUNTY DRAINAGE BOARD

JANUARY 22, 2003

REGULAR SESSION

President Williams brought the meeting to order.

 

CERTIFICATION OF ACTIVE COURT DRAINS AND DITCHES:

 

The Warrick County Drainage Board was presented with a list of all Legal Drains in Warrick County including Urban Drains with the total being 2,076,529 Lineal Feet or 393.282 Miles.

 

Karan Barnhill, Surveyor recommended approval of this list.

 

Commissioner Conner made a motion to accept the 393.282 miles of Legal Drains in Warrick County, Indiana, 2nd by Commissioner Baxter. Motion carried 3-0.

 

APPROVAL OF MINUTES:

 

Commissioner Conner made a motion to accept the minutes as presented, 2nd by Commissioner Baxter. Motion carried 3-0.

 

HUTCHINSON & WIRE DITCH QUOTES:

 

The quotes were passed to Mr. Ashley, Attorney for the Board to open. There were two quotes. The first quote was from Bigge Excavating for Hutchinson Ditch 2200 Lineal feet at $.75 per foot, the amount being $1,650.00.(at this time the quote from Aigner was opened as Mr. Ashley did not see the second piece of paper for Wires Ditch and Karan Barnhill wanted to take the quotes under advisement as Rod Madden stated the 2200 feet was only for one ditch, then the second page with the Wires Ditch quote was found.) The quote for Wires Ditch for 2,660 Linear feet at $.75 per foot the amount of $1,995.00. The total cost for both ditches is $3,645.00.

 

The second quote comes from Jerry Aigner Construction, Inc., with the total bid for both ditches being $5,103.00. There wasnít any linear footage or price per foot included.

Commissioner Conner made a motion to accept the quotes from Bigge Excavating in the amount of $3,645.00, 2nd by Commissioner Baxter. Motion carried 3-0.

 

OTTER CREEK QUOTES:

 

There were 4 quotes submitted and Mr. Ashley opened them and read as follows:

DG Constructionís quote in the amount of $3,900.00.

Jerry Aigner Construction, Inc., in the amount of $13,650.00

Ray Stradtner Excavating in the amount of $3,585.00.

Ruhe Excavating and Drainage in the amount of $11,585.00.

 

It was asked if all received the same information and Rod Madden answered that they all received the same specifications.

 

Commissioner Conner made a motion to accept the lowest quote, which was from Ray Stradtner Excavating in the amount of $3,585.00, 2nd by Commissioner Baxter. Motion carried 3-0.

 

SEITZ DITCH QUOTES:

 

There were also 4 quotes for Seitz Ditch and Mr. Ashley read them as follows:

DG Construction for the amount of $3,200.00

Jerry Aigner Construction, Inc., for the amount of $2,454.00.

Ray Stradtner Excavating for the amount of $2,485.00.

Ruhe Excavating and Drainage in the amount of $1,414.00.

 

There was discussion on previous unsatisfactory work that Ruhe Excavating and Drainage had completed. It was also noted that he did not always follow the recommended specifications and that he or a designated person was not at the pre-bid meeting where the specifications are read and questions answered.

 

Commissioner Baxter asked for a recommendation from the Surveyor.

 

Karan stated that with the past experiences she would have to recommend that the second lowest bidder be awarded the contract, which is Jerry Aigner Construction.

 

Commissioner Baxter made a motion to award the job to Jerry Aigner Construction, Inc., who was the second lowest bidder with a quote of $2,454.00, 2nd by Commissioner Conner. Motion carried 3-0.

 

 

 

 

COVENANT TO HOLD HARMLESS-MANN DITCH:

 

Karan explained to the Board about Mr. Frudenberg putting in a sewer line along Willow Pond Ditch and crossing Mann Ditch. The Drainage Board has received a Covenant to Hold the County Harmless from the Town of Newburgh but she explained that she is not happy about the wording of the Covenant. She added that she has contacted Tom Bodkin who is the Attorney for the Town of Newburgh and he has not answered her call, so she would like to continue this action until the next meeting.

 

Commissioner Conner made a motion to continue this action until further notice from the Surveyor, 2nd by Commissioner Baxter. Motion carried 3-0.

 

CLAIMS:

 

President Williams asked Karan if the claim to Purdue University was about the MS4 Storm Water program?He added that this was for registration, he would have like to have gone but his schedule prevented him from attending. He recommended that the Drainage Board allow this claim along with the others.

 

Commissioner Conner made a motion to pay the claims in the amount of $1,142.00, 2nd by Commissioner Baxter. Motion carried 3-0.

 

President Williams asked the Board Members if they had anything to come before the Board? He then asked Karan and Mr. Ashley.

 

Mr. Ashley stated he wanted the record to reflect the reasons for not accepting a low quote.

  1. If the low quote is not in line with the other quotes.
  2. If the Company or a designated person did not attend the pre-bid meeting.
  3. If the Jobs completed by the Company in the past did not meet the specifications of the Board and the work was unsatisfactory.

 

President Williams thanked Mr. Ashley and asked the Board for a motion to adjourn.

 

Commissioner Conner made a motion to recess, 2nd by Commissioner Baxter. Motion carried 3-0.
